Renting a boat comes with great responsibility, both for the skipper and the passengers. Before setting sail, we invite you to take a few minutes to read the following essential tips to ensure your time at sea is safe and enjoyable for everyone on board.

BEFORE SAILING

  • Choose a boat in optimal condition: Make sure the boat is fully operational and in excellent condition. It’s essential that it is registered in the 6th category list, ensuring insurance coverage for all passengers in case of an accident. A good bimini top is vital during certain times of the year, as well as having a table for dining and a solarium for sunbathing. A freshwater shower for rinsing off after swimming is also highly recommended. At Diverty Sea, we offer new boats, purchased in 2024, equipped with everything needed to ensure your comfort and safety.

DURING NAVIGATION

  • Plan your route: Consult our team at Diverty Sea for guidance on the best areas to sail, including coves and anchoring spots ideal for a refreshing swim.
  • Respect swimming areas: Navigation is prohibited in buoyed-off swimming areas. Avoid exceeding 3 knots in unmarked areas close to the shore, and never anchor in port access channels or marked swimming zones.
  • Safe anchoring: Never leave the boat unattended while anchored. Ensure proper anchoring by releasing enough rope and keeping a safe distance from other boats. Before anyone dives into the water, check that the boat is securely anchored and the engine is turned off.

FOR SWIMMERS

  • Precautionary measures: If children are on board, remove the ignition key to prevent the engine from being accidentally started. Make sure all passengers are back on board before lifting the anchor. Start the engine before lifting the anchor to avoid drifting.

PERSONAL SAFETY

  • Life jackets: While not mandatory for adults, ensure enough life jackets are on board for all passengers. It is highly recommended that children wear jackets appropriate for their age and weight.

INTERACTION WITH OTHER BOATS

  • Prioritize safety: Avoid crossing in front of other boats, especially large ones. Follow the RIPA rule of giving way to boats approaching from your right. Maintain a clear course and avoid sudden changes in direction.

IN CASES OF EMERGENCY

  • Act calmly: If a passenger falls overboard, gradually reduce speed, keep the person in sight at all times, and approach cautiously. Use the life ring and ladder to help them reboard the boat safely.

Following these tips will make your charter experience with Diverty Sea safe and enjoyable. Safety is our top priority, and we are here to guide you every step of the way in your maritime adventure.

  • Required Certification: A Navigation License is required to captain your adventure.
  • Secure Deposit: To confirm your reservation and ensure the integrity of your experience, we require a deposit of €400. This amount can be paid during check-in via Visa, MasterCard, or cash and will be refunded at the end of your maritime journey, unless you choose to hire a skipper, in which case no deposit is necessary.
  • Skipper Option: If you prefer to relax and enjoy the trip, we offer the option to hire an experienced skipper for €120/day or €70/half-day.
  • Mandatory Extras: Fuel consumption is additional, ensuring a worry-free journey.
  • Navigation Schedule: Your trip begins at 09:00 and ends at 18:30, designed to maximize daylight hours.
  • Home Port: All trips start and end exclusively at our home port, ensuring the safety and maintenance of our boats. The boat must remain at the home port overnight.
  • Flexibility with Weather: Safety is our top priority. In case of adverse weather conditions, we will provide an alternative to ensure you enjoy your experience.
  • Starting Point: Your adventure begins at Puerto Marina Salinas in Torrevieja (Alicante).

  • Prices Include: All our prices are transparent and include VAT, mooring at the home port, boat cleaning, boat insurance, and passenger insurance.
  • Not Included: Please note that skipper fees, fuel, and mooring fees at other ports are not included.
  • Required Documentation: To set sail without any issues, please bring your ID and Navigation License or a higher nautical qualification.
  • Safe Navigation: With a maximum navigation distance of up to 5 miles from the coast (or 2 miles with a basic license), we guarantee a safe experience for everyone on board.
  • Capacity: Up to 8 passengers (adults and children) can share this unforgettable experience.

THE CLIENT guarantees that the designated skipper for the boat mentioned in this contract possesses the necessary knowledge and experience to operate the rented vessel, holds the legally required license in Spain, and will have it available for inspection by relevant authorities for the duration of the contract.

DIVERTY SEA, as the LESSOR, rents out the recreational boat described in the Specific Conditions for the specified period and price, subject to the clauses of this contract.

THE CLIENT agrees to use the rented boat as if it were their property, following proper navigational standards and abiding by current laws. THE CLIENT is responsible for maintaining the boat and all its equipment in good condition during the rental period.

  • THE CLIENT must not exceed the authorized number of passengers.
  • The boat can only be used for recreational navigation and may not be employed for commercial or profit-making purposes or subleased.
  • The boat must remain within Spanish territorial waters and adhere to the navigational limitations outlined in the Specific Conditions.
  • THE CLIENT must not leave the boat anchored or moored unattended in open waters or unprotected areas without paid mooring rights.
  • THE CLIENT must not operate the boat under the influence of alcohol, drugs, or narcotics and must not carry illegal substances or weapons on board.

THE CLIENT is responsible for any damage, loss, or malfunction affecting the rented boat, its equipment, or the auxiliary boat and engine and for any delays in returning the boat. A security deposit detailed in the Specific Conditions must be provided to the LESSOR to cover any such issues, whether caused by misuse, negligence, accidents, or other reasons. This deposit will also cover delays in returning the boat without prejudice to any further claims for damages.

Accident Reporting:

THE CLIENT must immediately inform the LESSOR of any accidents, incidents, or malfunctions, regardless of their nature. In case of accidents, a written report detailing the causes, circumstances, and consequences must be prepared, including names and addresses of involved parties and witnesses if known. The LESSOR is not obligated to replace a damaged boat. THE CLIENT must inform the LESSOR before attempting any repairs.

UNILATERAL TERMINATION BY THE LESSOR

The LESSOR may terminate this contract if:

  • A) The boat is used for purposes other than recreational navigation, or payments are not made.
  • B) The skipper lacks sufficient knowledge or the required license.
  • C) The CLIENT or any passengers violate maritime regulations or use the boat negligently.

CANCELLATION POLICY

For reservations of one day or longer:

  • Less than 10 days’ notice: The deposit is forfeited.
  • 10 days to 1 month’s notice: 50% of the deposit is refunded.
  • More than 1 month’s notice: The deposit is fully refunded.

PENALTIES

  • For loss or damage to equipment:
    • Goggles: €20
    • Fins: €25
    • Snorkel: €10

    • Paddles: €25
    • Dinghy: €600 (loss or theft)
    • Dinghy engine: €600 (falling overboard, loss, or theft)

  • Delays in returning the boat:
    • A penalty of €100 will apply for late returns.
    • If the delay exceeds 2 hours and causes the next client to cancel, a penalty equivalent to an additional day’s rental fee will apply.

OBLIGATIONS OF THE LESSOR

The LESSOR will provide the boat with all safety equipment, documentation, valid insurance, and fully operational electronic devices. The boat will be delivered with a full fuel tank, and THE CLIENT agrees to return it in the same condition, including a full fuel tank, at their expense.

CANCELLATIONS OR DELAYS CAUSED BY THE LESSOR

If the LESSOR cancels the rental, the client will be refunded the rental cost. No additional compensation will be provided. If the LESSOR causes a delay exceeding two hours, the client may cancel the contract. In adverse weather, the LESSOR will offer an alternative date at no extra cost. If rescheduling is impossible due to force majeure, the LESSOR will refund the reservation fee.

DATA PROTECTION

By signing this contract, THE CLIENT consents to their data being processed by data protection laws. They have the right to access, rectify, or cancel their data as law allows.

DISPUTES AND LEGAL JURISDICTION

This contract is translated into English for convenience. In case of discrepancies, the Spanish version will prevail. All disputes will be resolved in the courts of Orihuela or Alicante, and both parties waive any other applicable jurisdiction.

Both parties acknowledge and agree to the terms by signing this contract in duplicate.

RESERVATION:

  • To reserve the boat for your desired date, the client must check availability and deposit 50% of the total reservation cost.
  • The remaining balance must be paid no later than the day of the reservation, before check-in, either in cash or by bank card.

CANCELLATIONS:

  • 100% Refund: If you cancel more than 1 month before the scheduled embarkation date.
  • 50% Refund: If you cancel over 10 days but less than 1 month before the rental date.
  • No Refund: If you cancel less than 10 days before the embarkation date. However, an alternative date may be offered, subject to availability.

Bad Weather Policy:

Safety comes first! We reserve the right to cancel your reservation in bad weather. In such cases, you may reschedule your reservation for another date; if this is not possible, a full refund of the amount paid will be issued.
